1. Introduction

Welcome to our game!

These Terms of Use ("Terms") govern your access to and use of the mobile games, applications, features and related services (collectively, the "Game") provided by RK Games B.V. ("RK Games", "we", "us" or "our").

By downloading, installing, accessing or playing the Game, you agree to these Terms. If you do not agree with these Terms, please do not use the Game.

These Terms apply to all users of the Game, including users who make in-app purchases or view advertisements.

2. Eligibility

You must comply with the minimum age requirements applicable in your country to use the Game.

If you are under the age of legal majority in your country, you must have permission from your parent or legal guardian to use the Game and make purchases.

Parents and legal guardians are responsible for supervising minors' use of the Game and any purchases made through their devices or accounts.

3. Use of the Game

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to download and use the Game for personal, non-commercial entertainment purposes, subject to these Terms.

You agree not to:

Use the Game for unlawful purposes.
Cheat, exploit bugs or manipulate the Game to obtain an unfair advantage.
Use bots, scripts, hacks, automation tools or unauthorized third-party software.
Reverse engineer, decompile, modify or attempt to extract the source code of the Game, except where permitted by applicable law.
Interfere with the Game's operation, servers, systems or security.
Attempt to access features, content or systems without authorization.
Sell, transfer or commercially exploit any part of the Game without our written permission.

We reserve the right to restrict or suspend access to the Game if you violate these Terms.

4. In-App Purchases

The Game may offer optional in-app purchases, including virtual currency, digital items, upgrades, additional features or other digital content.

All in-app purchases are processed through Google Play or the applicable platform's payment system.

By making a purchase, you agree to the applicable payment provider's terms and conditions.

4.1 Virtual Items and Currency

Virtual currency, digital items and other in-game content:

Have no real-world monetary value.
Cannot be exchanged for real money.
Cannot be transferred outside the Game.
Cannot be sold, traded or exchanged for goods or services outside the Game.
Are licensed to you for use within the Game and are not your personal property.

Virtual currency purchased in the Game may only be used within that Game.

4.2 Purchase Confirmation

Please carefully review all purchase details before confirming a transaction.

Prices are displayed in the applicable payment interface and may vary depending on your country, currency, taxes and applicable platform pricing.

RK Games does not directly collect or store your full payment card details when purchases are processed by Google Play.

4.3 Refunds

All purchases are subject to applicable consumer protection laws and the refund policies of Google Play or the relevant payment platform.

Refund requests should generally be submitted through Google Play.

Nothing in these Terms limits any mandatory refund, withdrawal, warranty or other consumer rights that you may have under applicable law.

Where applicable, digital content may be supplied immediately after purchase. Any loss of a statutory right of withdrawal will only apply where the legal requirements for obtaining your express prior consent and acknowledgement have been satisfied.

4.4 Changes to Virtual Items

We reserve the right to update, modify, balance or discontinue virtual items, virtual currency and other game content where reasonably necessary for technical, operational, security, legal or gameplay reasons.

We will respect your mandatory consumer rights when making such changes.

5. Advertisements

The Game may display advertisements to support its development and continued availability.

Advertisements may be provided by third-party advertising networks and partners.

These advertisements may include:

Banner advertisements.
Interstitial or full-screen advertisements.
Rewarded video advertisements.
Other advertising formats.

Third-party advertisers may collect or process certain information, including device identifiers, advertising identifiers and usage information, in accordance with applicable privacy laws and your advertising preferences.

We do not control all products, services or websites advertised by third parties and are not responsible for their content, products or services.

Your interaction with third-party advertisements may be subject to the advertiser's own terms and privacy policies.

We may collect and process information necessary to operate, maintain, improve and support the Game.

All rights, title and interest in and to the Game, including its software, graphics, designs, characters, animations, sounds, music, logos, trademarks and other content, belong to RK Games B.V. or its licensors.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

You may not copy, distribute, reproduce, modify, publish, sell or otherwise exploit any part of the Game without our prior written permission, except where permitted by applicable law.

8. Game Availability and Updates

We aim to keep the Game available and functioning properly.

However, we cannot guarantee that the Game will always be available, uninterrupted, error-free or compatible with every device.

We may:

Release updates, patches and improvements.
Change or introduce game features.
Temporarily suspend access for maintenance.
Modify or discontinue certain features where reasonably necessary.

We will provide updates and maintain the Game as required by applicable law.

Where a change materially negatively affects your access to or use of the Game, you may have additional rights under applicable consumer protection legislation.

9. Suspension and Termination

We may suspend or terminate your access to the Game if:

You materially violate these Terms.
You engage in cheating, fraud or other abusive behaviour.
Your use of the Game creates a security risk.
We are required to do so by law.

Where reasonably possible, we will provide notice before taking such action.

You may stop using the Game at any time by uninstalling it from your device.

Termination does not affect rights or obligations that arose before termination or any mandatory consumer rights.

10. Disclaimer

The Game is provided subject to the rights and protections available to you under applicable law.

To the maximum extent permitted by law, RK Games B.V. does not guarantee that the Game will be uninterrupted, completely error-free or available at all times.

Nothing in these Terms excludes or limits any statutory warranties, guarantees or consumer rights that cannot legally be excluded or limited.

11. Limitation of Liability

To the maximum extent permitted by applicable law, RK Games B.V. shall not be liable for:

Indirect or consequential losses.
Losses resulting from unauthorized modifications to the Game or use of unauthorized third-party software.
Losses resulting from your failure to maintain compatible devices or install necessary updates.
Interruptions caused by circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct or any other liability that cannot legally be excluded.

Nothing in this section affects your mandatory statutory rights as a consumer.

12. Third-Party Services

The Game may integrate or link to third-party services, including Google Play, advertising networks, analytics providers and other external services.

These services may be subject to separate terms and privacy policies.

RK Games B.V. is not responsible for the independent operation, availability or policies of third-party services, subject to any responsibilities imposed on us by applicable law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Game, our services, applicable laws or business operations.

The latest version will be made available through our designated website or another appropriate location.

If changes materially affect your rights or obligations, we will take reasonable steps to notify you.

Your continued use of the Game after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands.

Any disputes arising from or relating to these Terms shall be submitted to the competent courts in the Netherlands, subject to applicable mandatory consumer protection laws.

If you are a consumer residing in another country, you may also benefit from mandatory consumer protection provisions and jurisdictional rights under the laws applicable in your country of residence.

15. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall be interpreted or replaced to the extent necessary to make it enforceable while preserving its original purpose as closely as legally possible.
